Reservations of ‘holiday accommodation’ whether by the 'Internet' or 'Telephone', are accepted by ‘Lifeinabruzzo’ on the following conditions:
1. CONTRACT OF HIRE
The rental contract will be between you (the Renter) and Lifeinabruzzo on behalf of the owner of the establishment for which the booking is made upon and shall be deemed to be made subject to these Conditions of Rental and shall be interpreted and governed by EU Law and Jurisdiction. The Contract of Rental is not effective until Lifeinabruzzo despatches to the Renter written confirmation of the booking by email & receives a holding deposit of 50% of the total booking fee. The contract is for the rental of the property for holiday purposes only. Bookings from Renters under 18 years of age are not accepted.
2. INITIAL PAYMENT
Bookings will be confirmed upon receipt by Lifeinabruzzo.com of the required 50% deposit payment that is securely payable at the time of booking via PayPal.
3. BALANCE PAYMENT
The Balance of the Rental will be due for payment 14 days before the holiday commencement date. Lifeinabruzzo reserves the right to cancel a holiday where full payment has not been received 14 days before the holiday commencement date.
4. CREDIT CARDS
Deposits for holiday bookings may be made by credit or debit card without additional charge via PayPal.
5. VALUE ADDED TAX
VAT where applicable is included within the price given – there are no extra VAT charges of the prices listed on this website. Lifeinabruzzo’s ‘Confirmation of Booking’ is not a VAT invoice.
6. CONFIRMATION OF BOOKING
Once Lifeinbabruzzo has issued a Confirmation of Booking, you are responsible for ensuring the 50% outstanding is paid promptly within 14 days of your rental. You will be sent a reminder invoice 1 month from when the payment is due.
7. BOOKING CANCELLATION
Visitors are advised to make their own alternative arrangements to ensure cover upon their cancellation. If you are forced to cancel your holiday you must inform Lifeinabruzzo immediately. If you cancel up to 7 days prior to your official booking start date you will be reimbursed in full less a handling fee of 40 euros. If you cancel up to 3 days before you will be refunded 50% less a handling fee of 40 euros. If you cancel any time after this you will only be refunded 25% of your total invoice less 40 euros as a handling fee.
8. BOOKING FEE
A booking fee of 40 euros is charged for each booking, payable at the time of booking. The booking fee is non refundable.
The use of accommodation and amenities is entirely at the user's risk, and no responsibility can be accepted for injury, or loss or damage to user's or visitor's belongings. However, Lifeinabruzzo do not seek to exclude or limit legal liability for the negligence of their servants or agents.
10. PARTY NUMBERS
In no circumstances may more than the specified number of guests occupy the property. Each establishment owner reserves the right to refuse admittance if this condition is not observed. In addition, Lifeinabruzzo reserves the right to refuse or revoke any bookings from parties that may in their opinion (and at their discretion) be unsuitable for the property concerned.
11. YOUR RESPONSIBILITIES
For the whole of the period included within your booking, you will be responsible for the property and will be expected to take all reasonable care of it. The property and all equipment and utensils must be left clean and tidy at the end of any self-catering hire period.
All damages and breakages are the legal responsibility of the Renter and should be notified to the Keyholder before the end of your holiday. Their cost shall be refundable on demand. Minor damage or breakages will not normally be charged but in circumstances where extra cleaning is required or there has been breakage or damage beyond what is reasonably to be expected, Lifeinabruzzo reserve the right to charge you for any additional costs incurred as a consequence and may at their discretion refuse future bookings.
Keyholders reserves the right to repossess any Holiday Home at any time where you or any member of your party has caused damage. Lifeinabruzzo shall not be liable to make a refund of any remaining portion of the rental terms paid.
13. CUSTOMER SERVICE
If you are dissatisfied with the service you received you should follow the complaints procedure held in the handbook at Casetta Lucciola. In the event of any dispute between parties it will be governed by English Law as detailed in clause 15.
Lifeinabruzzo takes every care to ensure the accuracy of each property description. All information on our website is given in good faith and is believed to be correct at the time of going to press, but Lifeinabruzzo cannot be held responsible for changes beyond its control, which may become known after publication of this literature. Lifeinabruzzo's description of each available property shows the amenities available at that property but generally does not state what is not available.
Further, the Lifeinabruzzo will not be liable to you, any member of your party or person visiting the property during the period of your hire of it for happenings outside its reasonable control, such as breakdown of domestic appliances, plumbing, wiring, temporary invasion of pests, damage resulting from exceptional weather conditions or other unforeseeable circumstance.
In the event of any dispute between parties it shall be referred to the jurisdiction of the English courts only. Any contract shall be governed by English law and jurisdiction as this is where Lifeinabruzzo is registered.
Any disputes arising between you and Lifeinabruzzo, if not mutually resolved, can be referred to a single arbitrator agreed, or in the default of such agreement, to the President for the time being of the Law Society or Institute of Arbitrators. In either case, such arbitration would be subject to the provisions of the Arbitration Act of 1996 or any statutory modification thereof for the time being in force. All parties will contribute equally to the cost of Arbitration.
The Rental Contract is made on the understanding that the property and its facilities as published will be available for the dates stated. In the unlikely event that a property is not available through events arising outside the control of the Lifeinabruzzo, then Lifeinabruzzo may be forced to cancel the booking. You will be advised as early as possible. Where possible, you will be offered suitable alternative accommodation, which, if not acceptable, will entitle the Renter to a refund of all monies due. You will not as a result have any further claims against the Lifeinabruzzo. Please note that reservation requests taken via our website are not confirmed bookings until Lifeinabruzzo have contacted you and accepted your 50% deposit payment.
